Fees and Costs
- For Claims Under $10,000: Kenko Japan will cover all arbitration filing fees and administrative costs, unless the arbitrator determines the claim is frivolous or brought in bad faith.
- For Claims Over $10,000: The parties will split the arbitration fees in accordance with the AAA’s rules, unless otherwise agreed or ordered by the arbitrator.
- Each party will bear its own attorneys' fees and costs unless awarded by the arbitrator as part of the final decision.
Confidentially
All arbitration proceedings, including hearings, evidence submitted, and awards, will remain confidential. Neither party may disclose the content or outcome of the arbitration, except as required by law or to enforce the arbitrator’s decision.
Modification of Arbitration Agreement
Kenko Japan reserves the right to modify this Arbitration Agreement, but any changes will not apply to disputes filed before the modification’s effective date. Notice of any modifications will be provided on our Site.
Opt-Out Procedure
